International/Non-US Citizens

Persons who are lawful permanent residents or who are admitted as refugees are eligible to establish domicile in Colorado for tuition purposes. 

All petitioners who are not U.S. citizens can be classified in one of the following categories: 

  • Eligible to Establish Domicile
    • Permanent Residents; Proof of Green Card required
    • Other Lawful Status (Includes Refugee, Asylees, & Pending Permanent Residents); Proof of I-94 or Form I-485 required
    • Non-Immigrant Visitors; Proof of Visa required

**Note: Individuals in the following categories do not qualify to establish domicile:

  • F-1 or F-2
  • H-3 or H-4 (if the visa holder is the spouse or child of an H-3)
  • J-1 or J-2 (if the J-1 visa holder is a student or trainee)
  • M-1 or M-2

**Note: An individual who has not yet received a Resident Alien Card, but has filed the Application for Adjustment of Status may establish domicile with the one-year period beginning on the date the Application for Adjustment of Status was filed.

  • Not Eligible to Establish Domicile: 
    • DACA 
      • No citizenship documentation required
      • While they cannot establish domicile for tuition classification purposes, DACA students may qualify for In-State residency status rates under ASSET. If a student does not qualify for ASSET, then their residency status will be Out-of-State.
    • No Lawful Status/Undocumented 
      • No citizenship documentation required
      • While they cannot establish domicile for tuition classification purposes, undocumented students may qualify for In-State  residency status rates under ASSET.  If a student does not qualify for ASSET, then their residency status will be Out-of-State.
